JUDGMENT / ORDER

The petitioners herein are the three accused in Crime No. 1070/2014 of Chadayamangalam Police Station, registered under Sections 341, 323 r/w 34 of IPC and Section 4 of Kerala Prohibition of Ragging Act. Crime in the said case was registered on the complaint of the student Job Justine of Mathoma College, Chadayamangalam, that some senior students assaulted him, and committed ragging on him. Now the petitioners seek orders quashing the prosecution on the ground that they and the complainant have come to terms on the intervention of the parents and the teachers. To verify the truth of the settlement reported I directed both the parties to appear in court. Today the petitioners, and also the de facto complainant, appeared in court with their parents. On interacting with them, I find that the de facto complainant Job Justine happened to prefer the complaint on some misapprehension. He says that he had not in fact identified the students who assaulted him. On interacting with him, I find that what really happened is some joke played by the seniors. Anyway, Crl. M.C No. 5535 of 2014 2 there is reason to believe that Job justine happened to prefer complaint on some misapprehension. Now the whole dispute stands settled by the parties. Job Justine has filed affidavit as the second respondent herein, that he has settled the dispute with the accused, and that he has no grievance or complaint. The parents of the students present in court also submit that everything stand settled amicably, and that such instances will never be repeated. I find in the above circumstances that continuance of prosecution will cause harm and hardship to both the parties. In the result, this petition is allowed. The FIR in Crime No.1070/14 of Chadayamangalam Police Station will stand quashed under Section 482 Cr.P.C.
