Heard learned counsel for the petitioner and learned AGA for the State.
The petitioner against the order impugned here in this writ petition has already filed an appeal under Section 6 of the U.P. Goondas Act. The petitioner has also filed an application for interim relief alongwith the said appeal registered as Appeal No. C202108000000421.
It is submitted that on account of Pandemic Covid-19, the appeal preferred by the petitioner is not being proceeded with and his application for interim relief filed on 12.4.2021 has also not been considered by the appellate authority till date.
Learned counsel for the petitioner has submitted that the order of externment is thus being implemented without any opportunity of hearing having been granted to him particularly when the notice issued under the said Act was also not served upon the petitioner and this is a categorical ground taken in the appeal.
Looking to the facts and circumstances of the case, we hereby direct that the pending application for interim relief filed alongwith Appeal No. C202108000000421 may be considered by the appellate authority and necessary orders passed on the next date fixed i.e. 5.6.2021 without allowing any further delay to be caused in the matter.
The writ petition is disposed of accordingly.
