By way of present application, the applicant seek directions to the learned trial Court, Vadodara to release passport of the present applicant for the purpose of renewal and also permit the present applicant to apply for Haj, holy pilgrimage as well as to permit him to leave the country of India for the same.
Heard Mr.Jay M. Thakkar, learned advocate for the applicant. Mr.Thakkar has submitted that applicant wants to go for Haj. It is submitted that the validity of the passport of the applicant is upto dated 14.10.2011. The validity of the passport of the applicant has expired and, therefore, the applicant is required to renew the said passport. He has submitted that the passport of the present applicant is pending with the Sessions Court, Vadodara.
Heard Mr.H.L.Jani, learned Additional Public Prosecutor for respondent-State. He has strongly opposed this application.
In view of the averments made in the application, present application is partly allowed. The Sessions Court, Vadodara is directed to release the passport of the present applicant for renewal purpose. The applicant is directed to surrender the passport before the trial Court after renewal of the same. So far as second relief for going Haj pilgrimage is concerned, the applicant can apply before the trial Court and requests the trial Court for temporary release of the passport. Rule is made absolute to the aforesaid extent. Direct service is permitted.
