JUDGMENT / ORDER

This criminal original petition has been filed under Section 482 of Cr.P.C., to call for records in C.C.No.1 of 2009 on the file of the Chief Judicial Magistrate, Nagercoil and quash the same.
2.The Chief Judicial Magistrate, Nagercoil took the case on file as per the order of the Sessions Judge, Kanyakumari at Nagercoil in Crl.R.C.No.3 of 2005 dated 12.11.2008.
3.It is represented by both sides that the above mentioned order of the Sessions Judge has already been challenged in Crl.O.P.(MD) No.9692 of 2009 before this Court and the same has been reserved for orders after hearing the arguments.
4.C.C.No.1 of 2009 on the file of the Chief Judicial Magistrate, Nagercoil, now under challenge in this criminal original petition was taken on file as per the direction issued in the above mentioned order of the Sessions Judge. Taking the calender case on file is only a consequential order to that of the order of the Sessions Judge. When that order has already been challenged and the same is posted for orders, the present criminal original petitio is unnecessary. Therefore, this criminal original petition is dismissed. Consequently, connected miscellaneous petitions are also dismissed.
