Heard counsel for the parties.
The instant petition has been filed for a mandamus commanding respondent no.2 to release scholarship amount in favour of the petitioner for academic sessions 2014-15 and 2015-16. During these years, the petitioner was B. Tech. student at Quantum School of Technology, Roorkee. The petitioner claims that he had made several representations to the authorities but still the scholarship amount has not been released.
A counter affidavit has been filed by the State respondents in which it is admitted that the petitioner duly submitted application online for obtaining scholarship for academic sessions 2014-15 and 2015-16, but according to the respondents, the bank account number of the petitioner was not verified by Public Finance Management System, New Delhi on account of which the scholarship amount was not released. It is stated in the counter affidavit that the funds already allocated by the Central Government had got exhausted and request for release of more funds is pending and as soon as the remaining funds are received, the scholarship shall be paid to scheduled caste candidates according to the rules prescribed by the Government.
Learned standing counsel very fairly submitted that the Director, Social Welfare, Lucknow (respondent no.2) is competent to examine the grievance of the petitioner and take final decision in the matter.
Since it is not disputed that the petitioner had duly submitted the application but his request was not processed on account of non verification of the bank account by the Public Finance Management System, New Delhi, therefore, this Court is of the opinion that interest of justice would be served in permitting the petitioner to approach the second respondent with a certified copy of this order and a fresh representation and in which event, he shall pass a speaking order disposing of the claim of the petitioner within a period of next twelve weeks.
It is ordered accordingly.
The petition stands disposed of.
