This Writ Petition has been filed seeking for issuance of a Writ of Mandamus directing the respondent to issue the separate Patta to the petitioner in respect of the property in Survey No.336/55, to extent of 27 cents situated at Korkai Village, Srivaikundam Taluk, Tutuicorin District on the basis of the petitioner's representation dated 04.03.2017.
2.Heard Mr. A.Robinson, learned counsel appearing for the petitioner and Mr.M.Alagathevan, learned Special Government Pleader, appearing for the respondent.
3.By consent of both parties, the main Writ Petition is taken up for disposal, at the admission stage itself.
4.The case of the petitioner is that he purchased an extent of 27 cents in Survey No.336/55 at Korkai Village, Srivaikundam Taluk, Tutuicorin District by the registered sale deed dated 05.06.2013, and he is in possession of the property. The petitioner further stated that after registration of the sale deed, the respondent has issued a joint patta including the name of the other owners in the same survey numbers. So the petitioner approached the respondent seeking separate patta and also made a representation on 04.03.2017.
5.The learned counsel for the petitioner would submit that the petitioner is ready to pay necessary fees for sub-division and issuance of separate patta.
6.By considering the limited scope of the prayer sought for by the petitioner and the submission of the learned counsel for the petitioner, this Writ Petition is disposed of by directing the petitioner to make an application to the respondent after paying necessary fees within a period of two weeks. On such compliance, the respondent shall consider the same on merits and in accordance with law and pass orders, after giving opportunity to the necessary parties, if any, as expeditiously as possible, preferably within a period of eight weeks from the date of receipt of a copy of this order.
