Supplementary affidavit has been filed on behalf of the petitioners in the Court today, the same is taken on record.
Heard counsel for the parties.
This petition has been filed with a prayer to stay the arrest of the petitioners in the F.I.R. dated 20.06.2018, registered as Case Crime No. 1108 of 2018, under Section 366 of IPC, Police Station - Loni, District - Ghaziabad.
Akansha, petitioner no. 1 appears in the Court and states that she has voluntarily married to Rahul Kumar, petitioner no. 2. A copy of her date of birth certificate has been filed as Annexure No. 3 to the writ petition, wherein her date of birth is mentioned as 25.09.1999. In the first information report also, her age has been mentioned as 18 years.
Considering the submissions advanced by counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) of Cr.P.C., but shall co-operate with the investigation of the case.
With the aforesaid directions, this petition is finally disposed of.
