Heard learned counsel for the petitioner and learned standing counsel for the State-respondents.
Present petition has been filed with the following prayers:-
"(i) Issue a writ, order or direction in the nature of mandamus commanding the respondent no.3 to grant the license of Fair Price Shop on compassionate ground to the petitioner.
(ii) Issue, a writ, order or direction in the nature of mandamus restraining the respondent no.3 from creating any third party interest over the Fair Price Shop earlier Licensed in the name of late grandfather of the petitioner."
Learned counsel for the petitioner submitted he has filed representation before the respondent no.3 for allotment of fair price shop on compassionate ground, which was received in the office on 12.7.2021, but till date same has not been decided. He next submitted that a suitable direction may be issued to respondent No. 3 to decide the representation of the petitioner within stipulated period.
Learned Standing Counsel submitted that for such matter, Government Order dated 5.8.2019 is occupying the field and her representation shall be considered and decided in accordance with that.
Considering the facts and circumstances of the case, with the consent of the parties and without adverting on the merits of the case, the writ petition is disposed of directing the respondent No. 3 to decide the aforesaid representation of petitioner strictly in accordance with provision of Government Order dated 5.8.2019 or any other law occupying the field expeditiously, preferably within a period of six weeks from the date of production of computer generated copy of this order after verifying the same from official website of Allahabad High Court.
