Heard learned counsel for the petitioners; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 21.12.2020 registered as Case Crime No.114 of 2020, under Sections 419, 420, 467, 468, 471, 275, 120-B IPC;
and Section 8/22 of NDPS Act, P.S. Kamla Nagar, District Agra.
The allegations in the impugned first information report are serious in nature. The allegations are to the effect that counterfeit/adulterated drugs were being prepared and packed for sale. Large quantity of such drugs has been recovered from the premises of co-accused Aman Gupta. The complicity of the petitioners has come to light from the confessional statement of Aman Gupta who is son of the petitioner no.3 and brother of petitioners 1 and 2.
The learned counsel for the petitioners submits that as the thrust of the allegation is against Aman Gupta, the petitioners, who are household ladies, should not be harassed.
As according to the allegations Aman Gupta made a confessional statement disclosing involvement of his family members including petitioners, the prayer of the petitioners to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioners to apply for bail.
