Heard learned counsel for the petitioners; learned AGA for respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 28th November, 2019 registered as Case Crime No.1314 of 2019, under Sections 147, 148, 149, 336, 327 and 427 IPC and Section 3(1)(A) of Criminal Law (Amendment) Act, 1934 at Police Station Dadari, District Gautam Budh Nagar.
The impugned first information report is in respect of groups clash, causing injuries to many, despite effort by the police to disperse the mob.
The first information report has been lodged by naming as many as twenty persons including the petitioners.
As the allegations disclose commission of cognizable offences the prayer of the petitioners to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioners to apply for bail/anticipatory bail, as may be advised.
