Heard Sri Prabhat Tripathi, learned counsel for the applicant and Sri G. P. Singh, learned A.G.A. for the State.
This application has been filed with a prayer to expedite the Sessions Trial No. 190 of 2019, arising out of Case Crime no. 446 of 2018, under Sections 302 & 120B of I.P.C., Police Station Kydganj, District Prayagraj.
It has been argued by the learned counsel for the applicant that the applicant is informant in this case. The charges have been framed in this case on 21.08.2019 and since thereafter the case is not proceeding. Therefore, a direction is sought to be issued to the trial court for expeditious disposal of this case.
Learned A.G.A. has no objection.
Since, the courts were not functioning properly due to covid-19, hence it cannot be said that delay was committed by the trial court, though, it is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of two years from today without permitting undue adjournments to either side, if there is no legal impediment.
With aforesaid direction, this Application under Section 482 Cr.P.C. is finally disposed of without issuing any notice to O.P. No. 2 as it is an innocuous order. If the O.P. No. 2 feels aggrieved, he may approach this Court.
