Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record of this application.
In the similar matter on the same charge- sheet while taking note of the various facts and merit of the case, co- ordinate Bench of this Court previously on 14.8.2018 vide order dated 14.08.2018 in Application under Section 482 Cr.P.C. No.27566 of 2018 passed interim order in favour of one of the accused Vishal Goswami and present applicant Akash Goswami, copy whereof has been annexed as Annexure No.11 to the affidavit filed in support of this application. The same consequence follows in this application regarding merit of the applicant, therefore, the same effect shall follow in this application also as one was observed by order of co-ordinate Bench of this Court dated 14.8.2018 referred to hereinabove.
Matter requires consideration.
Issue notice to opposite party no. 2, returnable in four weeks.
List on the date fixed on notice.
Learned A.G.A. may also file appropriate return within the same period of time.
Until the date of next listing further proceedings of CNR No. UPGB040256162016 (State vs. Akash Goswami) arising out of Case Crime No. 406 of 2015, under Sections 420, 467, 468,471,120-B and 34 I.P.C., Police Station Bisrakh, District Gautam Buddh Nagar, pending in the Court of Additional Chief Judicial Magistrate-III, District Gautam Buddh Nagar shall remain stayed.
