Heard Shri Rajesh Kumar Roy Sharma, learned counsel for the petitioner, Shri Chandra Shekhar Mishra, learned counsel for the informant - respondent no. 3 and learned AGA for the State - respondents.
This writ petition has been filed praying for the following reliefs:
"(i) Issue a writ, order or direction in the nature of Certiorari quashing the impugned F.I.R. dated 26.06.2021 (Annexure No. 1 to the writ petition) registered as Case Crime No. 0279 of 2021, under Sections 498-A, 323, 504, 506, 377, 354 (ka), 376, 511, 307, IPC and 3/4 Dowry Prohibition Act, Police Station - Sadar Bazar, District - Saharanpur, with all its consequential effects.
(ii) issue a writ, order or direction in the nature of Mandamus directing the respondents not to harass/arrest the petitioner in pursuance of the impugned F.I.R. dated 26.06.2021 (Annexure No. 1 to the writ petition) registered as Case Crime No. 0279 of 2021, under Sections 498-A, 323, 504, 506, 377, 354 (ka), 376, 511, 307, IPC and 3/4 Dowry Prohibition Act, Police Station - Sadar Bazar, District - Saharanpur."
After the arguments were heard at some length, learned counsel for the petitioner states that the petitioner wants to withdraw the writ petition with liberty to apply for anticipatory bail/ bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioner.
In view of the aforesaid, the writ petition is disposed of with liberty to the petitioner to apply for anticipatory bail/ bail as permissible under law and in accordance with law.
It is made clear that we have not expressed any opinion on merits of the case of the petitioner.
