The outstanding dues admittedly have been paid by the petitioner in pursuance of an order dated 09.01.2018 passed by a Division Bench of this Court in Writ Petition No. 8029 of 2016 filed by the petitioners and others.
The claim in this writ petition is in respect of interest on the delayed payment. It is undisputed that the claim of interest was not allowed by this Court in the earlier writ petition, which clearly shows that the prayer made in this regard therein was not allowed and thus the same was rejected. It is not open to the petitioner to file a fresh writ petition in respect of the said claim.
This being the second writ petition for the same relief based on the same cause of action is thus not liable to be entertained and the same is accordingly dismissed.
