Heard learned counsel for the petitioner, Sri J.P.Singh, holding brief of Sri B.N.Singh for respondent no.4 and learned standing counsel for respondent nos.2, 3, 5 and 6.
The petitioner is working on the post of Junior Engineer in Lok Nirman Vibhag. He was nominated as Sector Magistrate in the Parliamentary Election to be held on 7.11.2009. Vide order dated 16.11.2009 he was placed under suspension on the charges that he has acted irresponsibly in depositing the Electronic Voting Machine (E.V.M.) and disciplinary inquiry into the charges were contemplated.
The grievance of the petitioner is that even though the inquiry has been concluded and inquiry officer has submitted a report dated 23.12.2009 exonerating him from the charges but till date no final orders have been passed and the petitioner continues to be under suspension.
Considering the facts and circumstances this writ petition stands disposed of with the direction to respondent no.3, the Executive Engineer, Temporary Division, Pradhan Mantri Gramin Sarak Yojana (PMGSY) Lok Nirman Vibhag, District Firozabad to take appropriate decision in the matter of the petitioner in the light of the inquiry report within a period of three weeks from the date of production of a certified copy of this order is before him.
It is, further, provided that in case, the final decision as directed is not taken within the time allowed, the suspension order of the petitioner shall automatically come to an end and he shall stand reinstated back on his post.
