Madras High Court|05 January, 2017

JUDGMENT / ORDER

This criminal original petition is filed to direct the respondents not to harass or ill-treat the petitioner on the guise of enquiry.
2.The learned counsel for the petitioner would submit that the respondent Police frequently called the petitioner to the Police Station and harassed him under the guise of enquiry.
3.The learned Government Advocate (Criminal Side) submitted that petitioner was called only for enquiry in respect of a complaint lodged by him and that the respondent Police will not cause any harassment to the petitioner.
4. In my considered view, no one can be harassed under the guise of investigation or enquiry by the police, which does not require any direction from this Court. Having regard to the rival submissions, more particularly, the statement made by the learned Government Advocate (Criminal Side) that the respondent ? police will not harass the petitioner, I am hopeful that the respondent ? police shall not harass the petitioner. Except making the above said observation, there is no need to issue any specific direction in this regard.
5. The Criminal Original Petition is disposed of with the above observation.
To
1.The Inspector of Police, Anti Land Grabbing Special Cell, Pudukkottai, Pudukkottai District.
2.The Inspector of Police, Prevention of Vigilance and Anti Corruption, Pudukkottai, Pudukkottai District.
3.The Additional Public Prosecutor, Madurai Bench of Madras High Court, Madurai..
