(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) 1.0 Out of the four appellants, the appeal in respect of appellant Nos. 1, 3 and 4, is requested to be disposed. During the pendency of the appeal, the Government of Gujarat has in exercise of powers conferred by Clause (B) of Section 5 of the Gujarat Police Act, 1951, made Rules further to amend the Police Sub-Inspector (Unarmed) Class-III Recruitment Rules, 2008 and those Rules of 2012 are published by notification dated 21.06.2012.
2.0 In view of the amendment brought about by the aforesaid Rules, the appeal in respect of aforesaid three appellants admittedly does not survive for any order as the aforesaid Rules would govern all the cases including the cases of the said appellants. Accordingly, by consent, the appeal in respect of appellant Nos. 1, 3 and 4 is disposed without entering into merits of the contentions and without any orders as to costs and it is clarified the the appeal survives as far as the appellant No. 2 is concerned and it is ordered to be listed for hearing along with Civil Application on 1st August 2012.
