Heard Sri D.S. Pandey, learned counsel for the applicant and Sri G.P. Singh, learned A.G.A. for the State.
The present application has been filed with a prayer to expedite the Sessions Trial No. 181 of 2018, in Case Crime No. 780 of 2017, under Sections 363, 366, 376, 368 IPC, and 3/4 POCSO Act, P.S. Patehrwa, District Kushi Nagar.
It has been argued by the learned counsel for the applicant that this case is pending before the trial court since 4.5.2018 and till date even presence of accused could not be secured by the trial court and no evidence has been recorded so far, hence prayer is made that a direction may be issued to the trial court to decide this case expeditiously.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of one year without permitting undue adjournments to either side, if there is no legal impediment.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court.
