1. By way of this petition under Article 226 of the Constitution of India, the petitioner who was working as Assistant Education Inspector with respondent No.4 herein has prayed for the following reliefs:-
"[A] YOUR LORDSHIPS be pleased to admit this Special Civil Application.
[B] YOUR LORDSHIPS be pleased to issue writ of mandamus or any other appropriate writ in nature of mandamus and issue a directions to respondents to grant the application at Annexure F & G made by the petitioner for giving certificate of Departmental Examination as per the resolution dated 11.4.2011, 8.4.2011 passed by the state government, Finance Department and granting pension with retirement benefits as early as possible in the interest of Justice.
[C] YOUR LORDSHIPS be pleased to grant such other and further reliefs in the interst of justice."
2. The matter was listed on 19.1.2012 and at the request of the Court, Mr. H.S. Munshaw, learned advocate generally appearing for respondent No.4 and Ms. Megha Chitaliya, learned AGP on advance copy were asked to inquire as to when the certificate indicating no examinations were held during the period would be issued to the petitioner and the matter was kept today for further orders.
3. Ms.
Megha Chitaliya, learned AGP, on instructions from respondent No.1, makes a statement that after verifying the record, the certificate as prayed for in the present petition would be issued to the petitioner within a period of 15 days.
4. Accordingly, the respondent authority shall issue certificate as per the statement made latest by 4.2.2012.
5. In view of the above, Mr. S.C. Sharma, learned advocate for the petitioner does not press this petition at this stage. Liberty to revive in case of difficulty by filing a note.
6. With these observations, the petition is disposed of. Direct service is permitted.
Registry is directed to send a copy of this order to Ms. Megha Chitaliya, learned AGP for its onward communication.
