The petitioner herein is seeking for a direction to the Family Court to have a speedy disposal of Ext.P1 & P4 pending before it.
2. Ext.P1 is the copy of the petition for divorce filed as O.P. No. 60/2014 which was originally filed before the Family Court, Thiruvananthapuram as O.P.No. 374/2013. Ext.P2 is the true copy of the petition O.P.(G&W) No. 885/2013 before the Family Court, Kottarakkara. Ext.P3 is the copy of O.P.No.743/2013 before the Family Court, Kottarakkara. Ext.P4 is the copy of M.C. No.121/2013 before the Family Court, Kottarakkara.
3. Going by the report of the Family Court , it is seen that the O.P.No.60/2014 is posted to 5.12.2014 for filing objection. O.P.(G&W) No.885/13 is posted for filing objection to 10.11.2014 and O.P.743/13 even though it is posted to O.P.(F.C.) No.518 of 2014 :2:
5.12.2014 for filing objection, the respondent has already filed objection in M.C. No. 121/2013, which is also posted on 5.12. 2014 for filing objection, the respondent has already filed objection.
4. Learned counsel for the petitioner submitted that speedy disposal of the cases is required, to have a final adjudication of all these cases. Going by the report of the Family Court, since, the parties are very adamant and there is no possibility for settlement, the cases will have to be taken for disposal on merits itself after taking evidence.
We therefore, direct the Family Court to dispose of the matters finally after giving opportunities to both sides to adduce evidence and after hearing within a period of six months from the date of production of a certified copy of the judgment.
