Rule. Mr.L.B.Dabhi, learned APP for opponent waives service of rule on behalf of State.
2. Heard learned advocate, MR.S.A.Qureshi for the applicant and learned APP, Mr.Dabhi for the State. Learned APP has produced on record a letter dated 12-3-2012 sent by the Medical Officer, Vadodara Central Jail, Vadodara, to Superintendent, Vadodara Central Jail, Vadodara, about the medical status and condition of the applicant which is taken on record.
3. This Court has gone through the above certificate paragraph No.4 whereof reads as under:
"At present patient is complaining of Hoarseness of voice, throat pain, dry cough, difficulty in swallowing semi-solid or liquid diet and unable to swallow solid food and weakness for last 3 to 4 weeks"
4. In view of the above report, this application is partly allowed. Applicant is ordered to be released on temporary bail in connection with offence registered as C.R.No.I-98 of 2010 with Padra Police Station, for a period of fifteen days from the date of his release on his executing personal bond of Rs.10,000/- (Rupees ten thousand only) with one solvent surety of the like amount to the satisfaction of the trial Court and subject to the conditions that during the aforesaid period, he shall not -
a) take undue advantage of his liberty or abuse his liberty;
b) to try to tamper or pressurise the prosecution witnesses or complainant in any manner;
c) maintain law and order and should cooperate the Investigating Officer;
d) not act in a manner injurious to the interest of the prosecution;
e) leave the State of Gujarat without prior permission of the Sessions Judge concerned;
Applicant shall surrender before the Jail Authority immediately after the period of fifteen days is over. Rule is made absolute to the aforesaid extent. Direct service is permitted.
