Heard learned counsel for the applicants.
The applicants are before this Court for a direction to initiate contempt proceeding against the opposite party for disobedience of the order dated 18.7.2018 passed in Writ-A No.14294 of 2018 filed by the applicants, whereby the writ petition was dismissed with following observation:-
"Learned Standing Counsel on the basis of instructions states that the questions, in respect of which petitioner has raised objection, have already been deleted and marks in accordance with law have been given to all candidates.
In view of the stand taken, no further grievance survives. Writ petition is, accordingly, dismissed."
Initially, the matter was taken up on 23.5.2019 and on the said date the Court had asked the applicant to serve a copy of the application on Shri K.R. Singh, learned Additional Chief Standing Counsel. In response thereof, an affidavit of compliance has been filed on behalf of opposite party on 5.9.2019 indicating therein that so far as question no.3 is concerned, three options were given and the applicant has claimed that none of the options were correct. While filing the affidavit of compliance, various exemplars have been cited by the opposite party and it is being claimed that the first option is correct and the applicant had answered wrong option. It has also been apprised that so far as the other questions, wherein wrong options were given, are concerned, the authority has already deleted such questions and accordingly, marks were allotted to the applicants.
The Court has proceeded to examine the record in question and perused the relevant materials available on record and is of the opinion that the first option of question no.3 was correct and the applicant has given wrong answer. In the circumstances the Court is not inclined to proceed in the matter under Section 12 of the Contempt of Courts Act, 1971.
The Application is totally misconceived and the same is accordingly dismissed.
