Ajit Pratap Singh vs Jitendra Kumar Singh

High Court Of Judicature at Allahabad|28 March, 2018
|

JUDGMENT / ORDER

Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 1585 of 2018 Applicant :- Ajit Pratap Singh Opposite Party :- Jitendra Kumar Singh, Tehsildar Counsel for Applicant :- Krishna Mohan Singh Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant.
This petition alleges disobedience of an order passed by the writ Court on 22 December 2016 requiring the expeditious disposal of a mutation case. The Court further observed that the competent authority would move in the matter according to its own roster and keeping in mind the oldest cases pending before it.
From a perusal of the order sheet it is evident that on umpteen occasions the matter has been adjourned on account of lawyers either abstaining from work or boycotting the court. It is also not evident from the record placed before this Court as to whether the mutation case of the applicant instituted in 2014 is the oldest case pending before the said authority.
In view of the above, this Court finds no ground to hold the opposite party in wilful or deliberate disobedience of the order of the Court.
The contempt petition is dismissed.
Order Date :- 28.3.2018 Arun K. Singh
