This criminal revision is directed against the judgment and order dated 5.3.2019 passed by the Addl. District Judge/Family Court/F.T.C. under 14, Finance Commission, Gorakhpur in Case No. 62 of 2014, Smt. Meena Verma versus Ajit Kumar Verma, under Section 125 Cr.P.C. District Gorakhpur.
Heard Sri Vivek Kumar Tripathi, Advocate holding brief of learned counsel for the revisionist, learned AGA and perused the record.
The only submission made by the learned counsel for the revisionist is that in other proceedings under the Domestic Violence Act the revisionist was directed to pay Rs. 5,000/- per month to the opposite party no.2-wife as maintenance amount. Therefore, the present order whereby the revisionist was directed to pay Rs. 2,000/- per month to the wife as maintenance amount was ilegal. The argument as has been raised by the learned counsel for the applicant is meritless and does not hold much water. The other proceedings are co-extensive and are not mutually exclusive to each other. If the law provides certain reliefs under the certain legislations the same cannot be stopped just because the other provisions made have already been used for the benefit of a particular party. Rs. 2,000/- as maintenance amount cannot be said to be either excessive or disproportionate in the present days of high price rise.
The revision lacks merit and stands dismissed.
