A prayer for adjournment has been made on the ground that counsel for the petitioner is out of station.
The writ petition arises out of proceedings under Section 122-B of the U.P. Zamindari Abolition and Land Reforms Act. On the proceedings being drawn against the petitioner, the Tehsildar on 28.08.2015 directed eviction of the petitioner and also imposed damages.
An application was filed for recall of this order, which was dismissed on 06.10.2016.
Against these orders, the petitioner has a statutory alternative remedy of a revision, which remedy was never availed by the petitioner.
Under the circumstances, this writ petition is barred by existence of a statutory alternative remedy.
The writ petition is dismissed as such with the observation that the petitioner, if so advised, may avail the statutory alternative remedy available to him for redressal of his grievance.
