Petitioner was directed to furnish security for release of the vehicle by the District Collector. Petitioner produced Ext.P4 certificate issued by the Service Co-operative Bank showing the liability in respect of the loan obtained by him by mortgaging the immovable property. Property seems stand in the name of the mother of the petitioner.

For the purpose of releasing the vehicle, if the immovable property is accepted as security, petitioner has to produce valuation certificate along with certificate showing that original of the title deed is with the Bank. Therefore, the third respondent shall issue a certificate showing that the original document is mortgaged with the bank for loan. Petitioner shall also produce valuation certificate in respect of the immovable property issued by a competent person. If the valuation is sufficient to create a security, the District Collector shall accept the above and release the vehicle in accordance with law without insisting original title deed.
The Writ Petition is disposed of as above.
