JUDGMENT / ORDER

Challenging Ext.P1 assessment order passed by the assessing officer on 31.05.2012, the petitioner had approached this Court earlier, in view of the coercive proceedings taken by way of Exts. P2 and P3. The said writ petition was disposed of as per Ext.P4 judgment dated 19.12.2012 directing the appellate authority to consider and pass orders in the appeals. This led to Ext.P5 order, which was sought to be challenged in W.P.(C)9635/2013, the fate of which was not favourable to the petitioner. 2. In the said circumstances, the petitioner preferred writ Appeal No.637 of 2013, joining hands with the other writ petitioner who was earlier a party to the proceedings. As per Ext.P6 judgment dated 12.04.2013, the above appellants were relegated to avail the statutory remedy by way of further appeal before the Tribunal. It is accordingly, that the petitioner has preferred Ext.P7 appeal along with Ext.P8 petition for stay, which are pending consideration before the 3rd respondent. Without any regard to the pendency of the above proceedings, the 2nd respondent has issued Ext.P9 notice under the Revenue W.P.(C). No. 26471 of 2014 2 Recovery Act, which made the petitioner to approach this Court again, by way of the present writ petition.
3. Heard the learned Government Pleader as well.
4. Considering the facts and circumstances, the 3rd respondent is directed to consider and pass appropriate orders on Ext.P8 petition for stay, in accordance with law, as expeditiously as possible, at any rate, within 'one month' from the date of receipt of a copy of this judgment. Coercive proceedings pursuant to Ext.P9 shall be kept in abeyance till such time.
The petitioner shall produce a copy of this judgment along with a copy of this writ petition before the concerned respondent for further steps. The writ petition is disposed of as above.
