Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Ajharudeen who is involved in Case Crime No. 696 of 2017, under Section 304 I.P.C., Police Station-Bhopa, District-Muzaffar Nagar.
As per prosecution version, on 21.9.2017 Anil Kumar (Lineman) who was working on contract basis has died due to electric current. At that time, it was told to him that current is not flowing in the wire.
Learned counsel for the applicant contends that applicant has been falsely implicated in this case. In the FIR SDO Kalicharan and Incharge Ajeet Singh were named but after investigation, they have not been made accused in this case. He further contends that no offence is made out against the applicant and the applicant is in jail since 8.12.2017.
Learned A.G.A., has opposed the prayer for bail.
In view of above, I find it a fit case for enlarging the applicant on bail. Let the applicant-Ajharudeen, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
