1. Heard Sri Abhishek Jaiswal, Advocate, holding brief of Sri Amit Daga, Advocate, for applicant, and learned A.G.A. for State.
2. The present bail application has been moved by accused applicant for enlarging him on bail in Case Crime No. 221 of 2015, under Sections 302, 326, 354 I.P.C. and Section 11/12 Protection of Children from Sexual Offences Act, Police Station Tiwaripur, District Gorakhpur.
3. The Informant has categorically stated in F.I.R. that applicant was seen pouring kerosene oil and setting the victim on fire causing her death. The incident was seen by Ram Awadh and Maina Devi, father and mother of Informant and both in their statements under Section 161 Cr.P.C. have supported F.I.R. version. Even in trial, Ram Awadh, father of Informant, has supported the prosecution version in his examination-in-chief as PW-2 and nothing contrary could be extracted in the cross-examination. Looking to the entire facts and circumstances, I do not find it a fit case for grant of bail.
4. Application is, accordingly, dismissed.
