1. Heard learned counsel for applicant and learned A.G.A. for State.
2. This is a bail application moved by accused-applicant for enlarging him on bail in Case Crime No. 233 of 2015, under Sections 498A, 304B, 323, 34, 302 IPC and 3/4 Dowry Prohibition Act, Police Station Baldev, District Mathura.
3. Applicant is the husband. Marriage was solemnized about an year back and on 23.07.2015 his wife died due to strangulation. Post mortem report has confirmed cause of death as a result of anti mortem hanging. Incident has taken place at applicant's residence but First Information Report has not been lodged by applicant or his family members but by brother of deceased. It is contended that applicant committed suicide and dead body was taken out after breaking door by police but it could not be disputed that police reached at site after the First Information Report was lodged by brother of deceased. Looking to entire facts and circumstances, I do not find it a fit case for grant of bail.
4. Application is accordingly dismissed.
