Case called out. None is present for the applicant, Heard learned AGA for the State and perused the record.
It is alleged in the first information report that one Manvendra Singh @ Manu is operating a gang with the help of four other members namely, Sanjay Sahani alias Sanjay Nishad, Ajit Tiwari alias Pankaj Tiwari, Tinku Paswan alias Radha Krishna Paswan and Rajiv alias Rishi Tiwari committed crime described in Chapter 16 in the Indian Penal Code and made it a profession for his profit.
The grounds taken for bail are that the applicant is a peaceful and law abiding citizen and he is not a gangster as defined under section 2/3 U.P. Gangster Act. The applicant has been falsely implicated in this case. The entire allegation made in the F.I.R. is baseless and concocted. The applicant is in jail since 21.12.2018.
Learned AGA opposed the prayer for bail.
Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, I am of the opinion that it is a fit case for bail.
Let the applicant Ajeet Tiwari Alias Pankaj Tiwari @ Arjit Tripathi@ Pankaj Tripathi involved in Case Crime No.556 of 2018, under Section 3(1) U.P. Gangster and Anti Social Activities (Prevention) Act, Police Station Shahpur District Gorakhpur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions;
1. The applicant will not tamper with the evidences.
2. The applicant will not pressurize/intimidate the prosecution witnesses and he will cooperate with the trial.
3. The applicant will appear on each and every date fixed by the trial court unless personal appearance is exempted by the court concerned.
In case of breach of any conditions mentioned above, the trial court shall be at liberty to cancel the bail of the applicant.
