Argument is that thousand of petitions challenging the transfer on the ground so taken in the writ petitions are pending and interim stay has been given against which the State filed Special Appeal which has also been dismissed. The aforesaid facts appears to be not in dispute. Court is informed that 12th July, 2010 is the date fixed in similarly situated matter.
In view of the aforesaid we propose to direct that the writ petition no. 34929 of 2010 which was dismissed against which, this appeal is there will again be listed before Hon'ble Single Judge along with other connected matters with writ petition no. 16035 of 2010 clubbed with other petitions. In view of the aforesaid order of Hon'ble Single Judge dated 15.06.2010 is hereby set aside.
The petitioner will continue on the post, where he was posted and pursuant to the order of transfer, he will not be disturbed unless this order is vacated. This appeal stand decided/allowed in the aforesaid terms and direction. Order Date :- 29.6.2010 M/A.
