Heard learned counsel for the petitioner and learned A.G.A. for the State.
This is a petition under Article 226 of the Constitution of India. The sole allegation against the present petitioner is that he has introduced the parties as a property dealer in purchasing the land and pursuant to that there was some fraud committed by the purchaser.
As far as the petitioner is concerned, these are the realm of disputed questions of the fact. However, if the petitioner moves the court-below with an application for enlarging him on bail, after considering his role played, the court may consider the case for bail on merits.
Petition is accordingly disposed of permitting the petitioners to file appropriate application before the court below.
Needless to state that in the eventuality of filing any such application, the same shall be decided expeditiously and strictly in accordance with law.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioners along with a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
