Heard learned Counsel for the parties.
In nutshell, the case of the petitioner is that the petitioner's father was posted as Constable under the opposite parties who died during service period on 21.3.1984. As the petitioner was minor on the date of death of the petitioner's father, he moved an application for compassionate appointment on attaining the age of majority on 21.8.2003.
Admittedly, the petitioner moved an application for compassionate appointment to the Additional Superintendent of Police (Establishment) beyond five years, as required under Uttar Pradesh Recruitment of Dependents of Government Servant Dying-in-Harness Rules, 1974, which was forwarded by the Deputy Inspector General of Police (Establishment) to the State Government for providing relaxation.
Learned Counsel for the petitioner submits that interest of justice would suffice, if the opposite party No.2 is directed to take a decision on the petitioner's representation and pass appropriate orders, expeditiously, to which learned Standing Counsel has no objection.
Accordingly, the opposite party No.2 is directed to take a decision on the petitioner's representation and pass appropriate orders, in accordance with law, within a maximum period of two months from the date of presentation of a certified copy of this order. It is clarified that this Court has not entered into the merits of the case. The writ petition stands disposed of finally in above terms. Order Date :- 8.1.2010 lakshman
