Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondent.
The grievance of the petitioners is that the stay application dated 29.8.2018 filed along with Appeal No. 2200 of 2018 (Ajeet Kumar and others Vs. Shrawan Kumar and others) before the Sub Divisional Officer, Tehsil Sadar, District Kannauj is pending consideration and as such the direction may be issued to decide the same either on the next date i.e. 22.10.2018 or within a short span of time by passing reasoned speaking orders and till disposal of stay application, the order impugned dated 9.7.2018 passed by Naib Tehsildar may be stayed.
Learned Standing Counsel fairly states that in case the stay application is still pending and has not been decided, the same will be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the competent authority to consider and decide petitioners' aforesaid application by a speaking order as expeditiously as possible and preferably within a period of three months from the date of production of a certified copy of this order before him.
