Heard learned counsel for the petitioner, learned standing counsel for the state-respondents and Sri P.P. Srivastava learned counsel for the respondent-Bank.
The petitioner is aggrieved by issuance of a recovery certificate dated 22.10.2019 of Rs.764951/-. The petitioner admits that he had taken loan of Rs.4,99,000/- from the respondent Bank in the year 2013 but could not pay the same. The submission of learned counsel for the petitioner is that the petitioner is a marginal farmer and as per the government policy, he is entitled to waiver of loan to the extent of Rs. one lac. It is point out that a representation (Annexure No.3) in this regard has already been made before the District Magistrate.
It is submitted that the representation may be directed to be decided within a specified time frame.
Counsel for the respondent Bank states that the petitioner is not covered by the waiver scheme.
Having regard to the submissions made, the petition is disposed of with liberty to the petitioner to make fresh representation alongwith certified copy of this order before the District Magistrate and in which event, the same shall be decided by him by means of a speaking order within four weeks. Payment of the amount under the recovery certificate shall abide by the decision that would be taken by the District Magistrate on the representation of the petitioner.
