Heard Sri M.B. Mathur, learned counsel for the appellant and learned AGA for the State.
This is the second bail application in the instant appeal. The first bail was rejected by this Court vide order dated 21.11.2017.
The instant criminal appeal has been filed by applicant-appellant against the judgement and order dated 17.03.2017 passed by Additional Session Judge/ FTC, Court no. 1, Siddharthnagar in S.T. No. 73 of 2004 (State vs. Bhumikeshwar Rai and others) arising out of Case Crime No. 52 of 2004, under sections 498-A, 304-B, 201 IPC and 3/4 of the Dowry Prohibition Act, P.S. Dharamwingwa, District Siddharthnagar.
Considering the facts and circumstances of the case that deceased died within one month of the marriage at her matrimonial home on account of throttling. Several other ante mortem injuries have also been noted by the doctor and the doctor has categorically stated that the deceased died on account of throttling. There is no fresh ground to grant bail to the appellant.
The bail application is hereby rejected.
Office is directed to prepare the paper book within two months.
List this case for hearing before appropriate Court in the first week of December, 2018.
