Sri Haribansh Singh, learned counsel appearing on behalf of Sri Dharamjeet Singh learned counsel for the petitioner submits that the petitioner is the plaintiff in Suit no 754 of 2012 Azimullah vs Anil Mishra alias Munna which is pending before the Civil Judge (JD) Poorvi Ballia. It is further submitted that the petitioner is aggrieved as Application No 6 C (Application for temporary injunciton) has not yet been decided finally by the learned trial court till date. He also submits that the plaintiff has fully cooperated on each date but it is the defendent who has been adopting delaying tactics.
Considered the submissions made across the bar and perused the record.
In the light of the judgment of Supreme Court in M/S Shiv Cotex Vs Tirjun Auto Plast P. Ltd and others 2011 (89) ALR 232, the court below is directed to decide the Application 6 C expeditiously within 8 weeks from the date of production of a certified copy of this order.
The petition is disposed of finally in terms of the above directions.
