Heard Shri Deepak Kumar Yadav, learned counsel for petitioner and learned A.G.A. for State of Uttar Pradesh.
This writ petition has been filed for quashing the F.I.R. dated 30.09.2018 registered as Case Crime No. 1379 of 2018, under Sections 307 I.P.C., Police Station- Kotwali Dehat, District- Bulandshahar.
A perusal of F.I.R. shows that the incident has taken place on 30.09.2018 at 12:00 night in which fire arm injury has been caused to Sarjil Mustafa and Riyan Mustafa.
Thus, F.I.R. disclosed the cognizable offence as such it is not liable to be quashed.
However, if petitioner appears and surrenders before the court below and applies for bail, then his prayer for bail shall be considered and decided in accordance with law expeditiously.
With the above directions, this writ petition is disposed of finally.
