JUDGMENT / ORDER

~ ~ ~ ~ ~ ~ Petition filed under Section 439 Cr.P.C. 2. Petitioner is the accused in Crime No.32/2014 of Kuzhalmannam Excise Range registered for the offence punishable under Section 55(a) of the Abkari Act.
3. The allegation against the petitioner is that on 12.09.2014 he was found transporting 248 litres of spirit in a secret chamber built in his mini lorry bearing registration No.KL-42-5280, through the Palakkad - Alathur National Highway. The petitioner has been in custody for the period from 12.09.2014 onwards.
4. Heard learned counsel for the petitioner and the learned Public Prosecutor.
5. This is a case in which the contraband involved is a huge quantity of spirit that too concealed in a secret BA.7639/2014 : 2 :
chamber specifically built for that purpose in the mini lorry of the petitioner. The contents of the CD, prima facie, reveal the complicity of the petitioner. Considering the gravity of the offence involved and the huge quantity of contraband that too spirit, I am of the view that the petitioner is not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
