Shri Pramod Kumar Singh, learned counsel for the petitioner submits that the appointment of fair price shop dealer of village panchayat Madak, District-Aligarh has to be made from the quota of the scheduled caste category candidates.
As per the Government Order dated 17.8.2002. The petitioner has submitted a representation in this regard to the respondent authority. However, the authorities have not taken any decision on the aforesaid representation and are proceeding for making an appointment in contravention of the government order.
Shri Sanjay Ram Tripathi, learned Standing Counsel contends that the submissions raised are disputed questions of fact which need to be investigation by the competent authority.
In view of the aforesaid submissions at the bar, the respondent No.5 is directed to decide the representation of the petitioner within a period of one month from the date of production of a certified copy of this order along with a fresh copy of the representation.
With the aforesaid direction, the writ petition is disposed of.
