Ajaykumar vs Secretary

High Court Of Gujarat|09 May, 2012

JUDGMENT / ORDER

1. Pursuant to the order dated 07.05.2012, Mr.A.J. Patel, Circle Officer, Palsana, is present in the Court. It is stated by Mr.Prabhav A. Mehta, learned advocate for the petitioners, that the certification of Entry No.6582 has been done on 24.03.2012 in breach of the status-quo order dated 10.02.2012 of this Court. It is stated by Mr.A.J. Patel, Circle Officer, that this error has occurred due to the wrong interpretation of the order of status-quo passed by this Court on 10.02.2012, and that he shall immediately take necessary steps to rectify the error.
2. Mr.A.J.
Patel, Circle Officer, has further tendered his unconditional apology for his action.
3. The explanation given by Mr.A. J. Patel, is not very convincing, considering that he has mentioned the order of this Court in the entry. However, the Court leaves it at this, for the time being. As it is clear that Entry No.6582 has been certified on 24.03.2012, in breach of the order dated 10.02.2012 of this Court, the following order is passed:
Status-quo ante as it existed on 10.02.2012, qua Entry No.6582 shall be restored. The certification of the said entry on 24.03.2012, stands cancelled. This order has been passed in the presence of Mr.R.S. Sanjanwala, learned Senior Advocate for respondent No.8, who has not raised any objection thereto.
List on 19.06.2012.
The status-quo order granted earlier, shall continue till then.
