JUDGMENT / ORDER

Only the devolution of the right of the plaintiff was sought to be clarified by the amendment of the plaint. Sufficient reasons have been stated by the petitioners as to why they could not take steps earlier. The suit is for declaration of title and injunction and its nature is not in any way altered.
2. I do not find any error of jurisdiction in the order impugned warranting interference. The petitioners can undoubtedly file an additional written statement to the amended plaint.
The Original Petition is dismissed.
