Heard learned counsel for the petitioner; learned A.G.A. for respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the First Information Report dated 1.4.2018 registered as Case Crime No. 64 of 2018, under Section366 I.P.C., at Police Station - Raunapar, District - Azamgarh.
On 17.1.2019 we required the learned A.G.A. to seek instructions as regards the status of the investigation.
The learned A.G.A. has obtained instructions and has stated that statement of victim has been recorded. From the statement so recorded a prima facie case is made out against the petitioner and that offence punishable under Section 376 I.P.C., has been added.
In view of the above, we do not find any good ground to quash the First Information Report. The petition is dismissed with liberty to the petitioner to apply for bail.
