Heard Shri Kailash Prakash Pandey, learned counsel for the petitioner and learned Standing Counsel for the State- respondents.
The petitioner claims to be a Class-IV employee and is working as a Cook in Reserve Police Line, Saharanpur. By the order impugned dated 22/27.12.2017 he has been transferred from Saharanpur to Shamli, which is in a different district and by order dated 31.12.2017 he has been relieved.
Learned counsel for the petitioner submits that according to Government's own decision, as far as possible, Class-IV employee should not be transferred outside the district.
It is not disputed that the petitioner holds a transferable post, as such, I am not inclined with the same. However, if there is any personal hardship occurring due to the transfer, it is always open for the employee to approach the higher authority, namely, Additional Director General of Police, Meerut Zone, Meerut.
In case the petitioner makes a representation to Additional Director General of Police, Meerut Zone, Meerut along with a certified copy of this order, the same shall be considered and decided in accordance with law within a period of one month from the date of filing of said representation.
For a period of one month the order of transfer dated 22/27.12.2017 as well as relieving order dated 31.12.2017 shall be kept in abeyance.
With the aforesaid directions, the writ petition is disposed of.
