Heard the learned counsel for the petitioner, learned standing counsel for the first and second respondent and Shri Yashvant Singh Sachan, learned counsel for the third, fourth and fifth respondent and Sri Chandan Sharma, learned counsel appearing for the sixth respondent.
Petitioner by the instant writ petition seeks a direction to the respondent to impose conditions upon the married daughter of the deceased-employee who had obtained compassionate appointment. Petitioner is the married brother of the deceased-employee.
Learned counsels for the respondents, at the outset, submit that the writ petition at the behest of the petitioner is not maintainable being not covered within the definition of 'family' under the Uttar Pradesh Recruitment of Dependants of Government Servants Dying in Harness Rules, 1974. It is further pointed out that earlier the wife of the deceased- employee had filed a petition bearing Writ Petition (A) No. 9506 of 2021, (Urmila Devi vs. State of U.P. and others), which was dismissed as withdrawn on 10.08.2021. On being confronted with the objection, learned counsel for the petitioner does not dispute the proposition.
In view thereof, writ petition being devoid of merit, accordingly, dismissed.
