Heard counsel for the petitioner and Standing Counsel for State of UP.
The writ petition has been filed for a mandamus commanding District Magistrate, Allahaabd (respondent-2) to decide Application No. 177 of 2008 filed by the petitioner for grant of Fire Arm Licence, expeditiously.
It has been stated that earlier the District Magistrate has rejected the application for grant of fire arm licence on 13.12.2011. The aforesaid order was challenged by the petitioner in appeal which was allowed by the Commissioner by order dated 5.8.2015 and matter has been remanded to the District Magistrate for deciding the application of the petitioner afresh. However, the District Magistrate has not passed any order till today.
Standing Counsel appearing on behalf of respondents states that at present there is change in the procedure and proforma for according license of the fire arms and the petitioner has to move fresh application as per the new norms framed under Arms Rules, 2016.
I have considered the arguments of the counsel for the parties.
Without entering into the controversy involved in the writ petition, the writ petition is disposed of with the observation that in case fresh application under Arms Rules, 2016 is moved by the petitioner within 15 days from today then same would be considered and decided by the competent authority in accordance with law on the same report as previously submitted in the application, expeditiously, preferably within a period of two months from the date of producing a certified copy of this order before the concerned authority.
