Heard the learned counsel for the applicant and the learned AGA appearing for the State.
This is an application brought by the applicant husband where an application for maintenance is pending since the year 2015.
The submission of the learned counsel for the applicant is that the wife is being paid interim maintenance as directed by the court below. Learned counsel further submits that it is his right to see an early conclusion to proceedings and a final determination of the wife's entitlement made.
Considering the fact that the applicant is the husband and is liable under any order for maintenance that may ultimately be passed he is certainly entitled to an early disposal of the maintenance matter though there is no such priority involved in the matter as in a case brought by an applicant for maintenance.
Looking to the overall facts and circumstances of the case, it is directed that the Principal Judge, Family Court, Agra shall proceed with and decide Criminal Case No.1042 of 2015 (Smt. Priyanka Vs. Ajay Singh) expeditiously as far as possible within a period of eight months next without granting any unnecessary adjournments to either of the parties, unless there be an order of stay granted by a Court of Superior Jurisdiction.
This application is disposed of with the above orders.
