Heard learned counsel for the petitioners and the learned Additional Government Advocate.
Issue notice to respondent no.4 returnable by 28.4.2010 through C.J.M., Lucknow fixing the appearance of respondent no.4 before this court on said date. The petitioners shall also appear on the said date.
Under challenge in the instant writ petition is the FIR relating to Case Crime No.98 of 2010 under Sections 448, 406, 420 IPC read with 138 Negotiable of Instruments Act.
There seems to be some dispute between the parties with respect to vacation of the house belonging to respondent no.4. The parties had settled their disputes with respect to sale of said house which is in possession of the petitioner of which certain amount was also paid by the petitioner to the respondent no.4.
Accordingly, we direct that the petitioners shall not be arrested in the aforesaid case crime number till 28.4.2010.
