Following orders were passed on 22.11.2018:-
"An objection with regard to maintainability of this petition is raised by Sri V.K. Upadhyay, learned Senior Counsel, assisted by Sri Ajeet Kumar Singh on the ground that the earlier petition filed by the present petitioner i.e. Writ Petition No. 16965 of 2016, since was dismissed by Division Bench of this Court on 18.4.2016, on merits, the second petition would not lie by virtue of Chapter-22 Rule- 7 of Rules of the Court.
Learned counsel for the petitioner seeks a short indulgence to respond.
As prayed, put up this matter, as fresh, on 28.11.2018."
Although the learned counsel for the petitioner makes various submissions but has not disputed that this petition is second petition on the same cause. Even if the grounds, which are argued now, were not raised earlier, yet a second petition would be barred by principles of constructive res- judicata.
Writ petition is dismissed.
